This website and its contents are protected by current legislation on intellectual property.Amino Groupis the owner or licensee of all intellectual and industrial property rights of its website, as well as of the elements contained therein. Therefore, the reproduction, distribution, public communication and transformation of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of Terms and Conditions, is expressly prohibited.The trademarks, trade names or distinctive signs are owned by Amino Groupeither by industrial or intellectual property, without it being understood that access to the Portal attributes any right over the aforementioned trademarks, trade names and/or distinctive signs.All products and services on these pages that are NOT owned by Amino Groupare registered trademarks of their respective owners and are recognised as such by our company. They only appear on the Amino Group website for promotional and information gathering purposes. These owners may request modification or deletion of the information belonging to them.

Terms of use of the portal

3.1 GeneralThe User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice. The User will be liable to Amino Groupor third parties for any damages that may be caused as a result of a breach of this obligation.It is expressly forbidden to use the Portal for purposes harmful to the property or interests of Amino Groupor third parties or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and computer applications (software) of Amino Groupor third parties.3.2 ContentThe User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with any other conditions, regulations and instructions that may be applicable in accordance with the provisions of clause 1.By way of example only, the User, in accordance with current legislation, must abstain from:– Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents except in cases authorised by law or expressly consented to by Amino Groupor by whoever holds the ownership of the exploitation rights where applicable.– Reproduce or copy for private use the Contents that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as its public communication or making it available to third parties when these acts necessarily imply the reproduction by the User or a third party.– Extract and/or reuse all or a substantial part of the Contents of the Portal as well as the databases that Amino Groupmakes available to Users.3.3 Introduction of links to the PortalInternet users who wish to introduce links from their own web pages to the Portal must comply with the conditions detailed below, without ignorance of these conditions avoiding the responsibilities derived from the Law:– The link will only link to the home page or main page of the Portal but may not reproduce it in any way (online links, copy of texts, graphics, etc.).– In accordance with the applicable legislation in force at any given time, it is forbidden in any case to establish frames of any kind that surround the Portal or allow the Contents to be viewed through Internet addresses other than those of the Portal and, in any case, when they are displayed together with contents outside the Portal in such a way that: (I) produces, or may produce, error, confusion or deception in users about the true origin of the service or Contents; (II) involves an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of the brand and prestige of Amino Groupor (IV) in any other way is prohibited by current legislation.– No false, inaccurate or incorrect statements about Grupo Amino, its partners, employees, clients or about the quality of the services it provides shall be made from the page that introduces the link.– Under no circumstances shall it be stated on the page where the link is located that Amino Grouphas given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises the services of the sender.– The use of any word, graphic or mixed brand or any other distinctive sign of Amino Groupwithin the sender’s page is prohibited except in cases permitted by law or expressly authorised by Amino Groupand provided that, in these cases, a direct link to the Portal is permitted in the manner established in this clause.– The page that establishes the link must comply faithfully with the law and may not under any circumstances provide or link to its own or third party content that: (I) is unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (II) induces or leads to the creation of a link to any content that: (I) is unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.). ); (II) induce or may induce in the User the false conception that Amino Groupsubscribes to, endorses, adheres to or in any way supports the ideas, statements or expressions, legal or illegal, of the sender; (III) are inappropriate or not relevant to the activity of Amino Groupin view of the place, content and theme of the sender’s website.

Exclusion of liability

4.1 InformationAmino Groupshall not be liable for decisions taken on the basis of the information provided on the Portal or for any damages caused to the User or third parties as a result of actions based solely on information obtained from the Portal.4.2 Quality of serviceAccess to the Portal does not imply any obligation on the part of Amino Groupto control the absence of viruses, worms or any other harmful computer element.It is the responsibility of the User, in any case, to ensure the availability of adequate tools for the detection and disinfection of harmful computer programs.Amino Groupshall not be liable for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.4.3 Availability of the ServiceAccess to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity and operation does not correspond to Grupo Amino. Therefore, the services provided through the Portal may be suspended, cancelled or become inaccessible, prior to or simultaneously with the provision of the Portal service.Amino Groupshall not be liable for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Portal service during or prior to the provision of the same.4.4 Content and services linked through the PortalThe Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, Amino Groupacts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce (LSSI) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the unlawfulness and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, he/she may notify Amino Groupin accordance with the procedure and the effects established in clause 6, without this notification in any case entailing the obligation to remove the corresponding link.Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the responsible or owners of the same, nor the recommendation, promotion or identification of Amino Groupwith the statements, content or services provided.Amino Groupis not aware of the contents and services of the Linked Sites and therefore is not liable for any damage caused by the unlawfulness, quality, failure to update, unavailability, error and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to Grupo Amino.

Communication of activities of an illicit and inappropriate nature

In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose content or services are unlawful, harmful, denigrating, violent or contrary to morality, he/she may contact Amino Groupindicating the following:

Personal data of the caller: name, address, telephone number and e-mail address;
Description of the facts that reveal the unlawful or inappropriate nature of the Linked Site;
In the event of infringement of rights, such as intellectual and industrial property, the personal data of the owner of the infringed right when this is a person other than the communicating party.
You must also provide the title accrediting the legitimacy of the holder of the rights and, where appropriate, the title of representation to act on behalf of the holder when it is a person other than the communicating party;
Express declaration that the information contained in the claim is accurate.

Receipt by Amino Groupof the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, actual knowledge of the activities and/or contents indicated by the communicating party.You must also provide the title accrediting the legitimacy of the holder of the rights and, where appropriate, the representation to act on behalf of the holder when it is a person other than the caller.

Notifications

All notifications and communications made by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be considered effective, for all purposes, if they are made through the Portal itself.

Modifications

Amino Groupreserves the right to make any modifications it deems appropriate to its website without prior notice, being able to change, delete or add both the contents and services provided through the website and the way in which they are presented.On the other hand, these terms and conditions may change at any time. Legislation

El presente aviso legal recoge las condiciones generales que rigen el acceso y el uso de este sitio web, en adelante “el sitio web”. El uso del sitio web implica la expresa y plena aceptación de estas condiciones generales en la versión publicada en el momento en que el usuario acceda al mismo, sin perjuicio de las condiciones particulares que pudieran aplicarse a algunos de los servicios concretos del sitio web.

Propiedad intelectual e industrial

Este sitio web y los contenidos que alberga se encuentran protegidos por la legislación vigente en materia de propiedad intelectual.

Grupo Amino es titular o licenciatario de todos los derechos de propiedad intelectual e industrial de su web, así como de los elementos contenidos en la misma. Por ello, queda expresamente prohibida la reproducción, distribución, comunicación pública y transformación de la totalidad o parte de los contenidos de esta web, con fines comerciales, en cualquier soporte y por cualquier medio técnico, sin la autorización de Términos y Condiciones.

Las marcas, nombres comerciales o signos distintivos son titularidad de Grupo Amino ya sea por propiedad industrial o intelectual, sin que pueda entenderse que el acceso al Portal atribuya ningún derecho sobre las citadas marcas, nombres comerciales y/o signos distintivos.

Todos los productos y servicios de estas páginas que NO son propiedad de Grupo Amino son marcas registradas de sus respectivos propietarios y son reconocidas como tales por nuestra empresa. Solamente aparecen en la web de Grupo Amino a efectos de promoción y de recopilación de información. Estos propietarios pueden solicitar la modificación o eliminación de la información que les pertenece.

Condiciones de uso del portal

3.1 General

El Usuario se obliga a hacer un uso correcto del Portal de conformidad con la Ley y el presente Aviso Legal. El Usuario responderá frente a Grupo Amino o frente a terceros, de cualesquiera daños y perjuicios que pudieran causarse como consecuencia del incumplimiento de dicha obligación.

Queda expresamente prohibido el uso del Portal con fines lesivos de bienes o intereses de Grupo Amino o de terceros o que de cualquier otra forma sobrecarguen, dañen o inutilicen las redes, servidores y demás equipos informáticos (hardware) o productos y aplicaciones informáticas (software) de Grupo Amino o de terceros.

3.2 Contenidos

El Usuario se compromete a utilizar los Contenidos de conformidad con la Ley y el presente Aviso Legal, así como con las demás condiciones, reglamentos e instrucciones que en su caso pudieran ser de aplicación de conformidad con lo dispuesto en la cláusula 1.

Con carácter meramente enunciativo, el Usuario de acuerdo con la legislación vigente deberá abstenerse de:

Reproducir, copiar, distribuir, poner a disposición, comunicar públicamente, transformar o modificar los Contenidos salvo en los casos autorizados en la ley o expresamente consentidos por Grupo Amino o por quien ostente la titularidad de los derechos de explotación en su caso.
Reproducir o copiar para uso privado los Contenidos que puedan ser considerados como Software o Base de Datos de conformidad con la legislación vigente en materia de propiedad intelectual, así como su comunicación pública o puesta a disposición de terceros cuando estos actos impliquen necesariamente la reproducción por parte del Usuario o de un tercero.
Extraer y/o reutilizar la totalidad o una parte sustancial de los Contenidos integrantes del Portal así como de las bases de datos que Grupo Amino ponga a disposición de los Usuarios.

3.3 Introducción de enlaces al Portal

El usuario de Internet que quiera introducir enlaces desde sus propias páginas web al Portal deberá cumplir con las condiciones que se detallan a continuación sin que el desconocimiento de las mismas evite las responsabilidades derivadas de la Ley:

El enlace únicamente vinculará con la home page o página principal del Portal pero no podrá reproducirla de ninguna forma (online links, copia de los textos, gráficos, etc).
Quedará en todo caso prohibido, de acuerdo con la legislación aplicable y vigente en cada momento, establecer frames o marcos de cualquier tipo que envuelvan al Portal o permitan la visualización de los Contenidos a través de direcciones de Internet distintas a las del Portal y, en cualquier caso, cuando se visualicen conjuntamente con contenidos ajenos al Portal de forma que: (I) produzca, o pueda producir, error, confusión o engaño en los usuarios sobre la verdadera procedencia del servicio o Contenidos; (II) suponga un acto de comparación o imitación desleal; (III) sirva para aprovechar la reputación de la marca y prestigio de Grupo Amino o (IV) de cualquier otra forma resulte prohibido por la legislación vigente.
No se realizarán desde la página que introduce el enlace ningún tipo de manifestación falsa, inexacta o incorrecta sobre Grupo Amino, sus socios, empleados, clientes o sobre la calidad de los servicios que presta.
En ningún caso, se expresará en la página donde se ubique el enlace que Grupo Amino ha prestado su consentimiento para la inserción del enlace o que de otra forma patrocina, colabora, verifica o supervisa los servicios del remitente.
Está prohibida la utilización de cualquier marca denominativa, gráfica o mixta o cualquier otro signo distintivo de Grupo Amino dentro de la página del remitente salvo en los casos permitidos por la ley o expresamente autorizados por Grupo Amino y siempre que se permita, en estos casos, un enlace directo con el Portal en la forma establecida en esta cláusula.
La página que establezca el enlace deberá cumplir fielmente con la ley y no podrá en ningún caso disponer o enlazar con contenidos propios o de terceros que: (I) sean ilícitos, nocivos o contrarios a la moral y a las buenas costumbres (pornográficos, violentos, racistas, etc.); (II) induzcan o puedan inducir en el Usuario la falsa concepción de que Grupo Amino suscribe, respalda, se adhiere o de cualquier manera apoya, las ideas, manifestaciones o expresiones, lícitas o ilícitas, del remitente; (III) resulten inapropiados o no pertinentes con la actividad de Grupo Amino en atención al lugar, contenidos y temática de la página web del remitente.

Exclusión de responsabilidad

4.1 De la Información

Grupo Amino no se responsabiliza de las decisiones tomadas a partir de la información suministrada en el Portal ni de los daños y perjuicios producidos en el Usuario o terceros con motivo de actuaciones que tengan como único fundamento la información obtenida en el Portal.

4.2 De la calidad del servicio

El acceso al Portal no implica la obligación por parte de Grupo Amino de controlar la ausencia de virus, gusanos o cualquier otro elemento informático dañino.

Corresponde al Usuario, en todo caso, la disponibilidad de herramientas adecuadas para la detección y desinfección de programas informáticos dañinos.

Grupo Amino no se responsabiliza de los daños producidos en los equipos informáticos de los Usuarios o de terceros durante la prestación del servicio del Portal.

4.3 De la disponibilidad del Servicio

El acceso al Portal requiere de servicios y suministros de terceros, incluidos el transporte a través de redes de telecomunicaciones cuya fiabilidad, calidad, continuidad y funcionamiento no corresponde a Grupo Amino Por consiguiente, los servicios proveídos a través del Portal pueden ser suspendidos, cancelados o resultar inaccesibles, con carácter previo o simultáneo a la prestación del servicio del Portal.

Grupo Amino no se responsabiliza de los daños o perjuicios de cualquier tipo producidos en el Usuario que traigan causa de fallos o desconexiones en las redes de telecomunicaciones que produzcan la suspensión, cancelación o interrupción del servicio del Portal durante la prestación del mismo o con carácter previo.

4.4 De los contenidos y servicios enlazados a través del Portal

El servicio de acceso al Portal incluye dispositivos técnicos de enlace, directorios e incluso instrumentos de búsqueda que permiten al Usuario acceder a otras páginas y portales de Internet (en adelante, ‘Sitios Enlazados’). En estos casos, Grupo Amino actúa como prestador de servicios de intermediación de conformidad con el artículo 17 de la Ley 34/2002, de 12 de julio, de Servicios de la Sociedad de la Información y el Comercio Electrónico (LSSI) y sólo será responsable de los contenidos y servicios suministrados en los Sitios Enlazados en la medida en que tenga conocimiento efectivo de la ilicitud y no haya desactivado el enlace con la diligencia debida. En el supuesto de que el Usuario considere que existe un Sitio Enlazado con contenidos ilícitos o inadecuados podrá comunicárselo a Grupo Amino de acuerdo con el procedimiento y los efectos establecidos en la cláusula 6, sin que en ningún caso esta comunicación conlleve la obligación de retirar el correspondiente enlace.

En ningún caso, la existencia de Sitios Enlazados debe presuponer la existencia de acuerdos con los responsables o titulares de los mismos, ni la recomendación, promoción o identificación de Grupo Amino con las manifestaciones, contenidos o servicios proveídos.

Grupo Amino no conoce los contenidos y servicios de los Sitios Enlazados y por tanto no se hace responsable por los daños producidos por la ilicitud, calidad, desactualización, indisponibilidad, error e inutilidad de los contenidos y/o servicios de los Sitios Enlazados ni por cualquier otro daño que no sea directamente imputable a Grupo Amino.

Comunicación de actividades de carácter ilícito e inadecuado

En el caso de que el Usuario o cualquier otro usuario de Internet tuvieran conocimiento de que los Sitios Enlazados remiten a páginas cuyos contenidos o servicios son ilícitos, nocivos, denigrantes, violentos o contrarios a la moral podrá ponerse en contacto con Grupo Amino indicando los siguientes extremos:

Datos personales del comunicante: nombre, dirección, número de teléfono y dirección de correo electrónico;
Descripción de los hechos que revelan el carácter ilícito o inadecuado del Sitio Enlazado;
En el supuesto de violación de derechos, tales como propiedad intelectual e industrial, los datos personales del titular del derecho infringido cuando sea persona distinta del comunicante.
Asimismo deberá aportar el título que acredite la legitimación del titular de los derechos y, en su caso, el de representación para actuar por cuenta del titular cuando sea persona distinta del comunicante;
Declaración expresa de que la información contenida en la reclamación es exacta.

La recepción por parte de Grupo Amino de la comunicación prevista en esta cláusula no supondrá, según lo dispuesto en la LSSI, el conocimiento efectivo de las actividades y/o contenidos indicados por el comunicante.

Asimismo deberá aportar el título que acredite la legitimación del titular de los derechos y, en su caso, el de representación para actuar por cuenta del titular cuando sea persona distinta del comunicante.

Notificaciones

Todas las notificaciones y comunicaciones realizadas por las partes serán válidas de conformidad con los medios admitidos en Derecho. Las relativas al presente Portal se considerarán eficaces, a todos los efectos, si se realizan a través del propio Portal.

Modificaciones

Grupo Amino se reserva el derecho de efectuar sin previo aviso las modificaciones que considere oportunas en su web, pudiendo cambiar, suprimir o añadir tanto los contenidos y servicios que se presten a través de la misma como la forma en la que éstos aparezcan presentados.

Por otro lado, los presentes términos y condiciones podrán cambiar en cualquier momento. Las modificaciones entrarán en vigor desde el momento de su publicación.

Redes Sociales

Grupo Amino está presente en diversas redes sociales y plataformas, por lo tanto, cuando se accede a cualquiera de estas u otras redes, habrá que tener en cuenta que las condiciones de uso aplicables son las que cada plataforma tiene establecidas, en las cuales, Grupo Amino no interviene.

Legislación

El presente Aviso Legal se rige en todos y cada uno de sus extremos por la ley española Siempre y cuando la Ley aplicable permita la renuncia al fuero legal establecido, se designa como fuero para dirimir posibles disputas, los juzgados de Málaga, renunciando expresamente el usuario a cualquier otro fuero que pudiera corresponder.
